The new language, says Walsh, will apply to any backer, both those who have already agreed to the previous terms, as well as potential testers who declined to sign it due to concerns about recourse rights. This is, of course, after actually criticizing players and influencers for reacting with “suspicion” to the deal, when they should do so as of right. While claiming that this does not reflect a “change in substance of the agreement,” Walsh argues that the rewording of the NDA is a way to better “clarify” their intention when presenting the NDA agreement to Kingdoms of Elyria. Well, it looks like the Soulbound Studios team has figured this out and are apparently determined to bring these backers into the Alpha, as CEO Jeromy Walsh announced this week via the studio’s website that the NDA is being edited. While the language is actually pretty standard for NDAs, against the backdrop of the current class action lawsuit by donors already underway, many potential testers urged themselves not to sign the NDA due to the language. Skeptical supporters (and they have every right to be skeptical) saw this potentially as a way for them to effectively dismiss their claims to sue the studio, both retroactively and in the future. If you remember, when the Kingdoms of Elyria alpha began, eagle-eyed users spotted disturbing language in the NDA deal that would see players potentially waiving their right to legal action against Soulbound Studios.
